What if my executor lives outside Canada?

The Canadian position

An out-of-province or foreign estate trustee commonly must post security unless the will waives it or the beneficiaries consent.

Tax residency of the trustee can also affect the estate's own tax position.

The Islamic position

No religious obstacle, but the duty is real work. Appointing someone who cannot realistically perform it is a poor discharge of the trust.

Researched — the schools differ

All four schools want the same qualities in a wasi — adulthood and legal capacity, Islam, integrity and the ability to do the job. They differ on what failing one of them does. Three schools treat them as conditions of validity, so an appointment that fails one is void. The Hanafi school treats the appointment as valid and puts the remedy in the judge’s hands.

What to do about it

  1. Prefer a resident executor where possible.
  2. Waive the bond in the will if you appoint someone abroad.
  3. Name a resident co-executor or alternate.
