Islamic practice is within a day. Canadian administration — registration, burial permit, cemetery scheduling — usually permits it, unless a coroner is involved.
The Canadian position
A burial permit is required and is normally obtained by the funeral director once the death is registered. Coroner involvement can add days.
The Islamic position
Prompt burial is strongly preferred. Where a legal process delays it, scholars generally treat the delay as a necessity rather than a failing.
Hastening the burial is recommended, not obligatory, and no school lays down a 24-hour rule — that figure is a community convention, not a fiqh ruling. What the schools differ on is how serious a delay is: the Hanafi, Maliki and Hanbali schools call it disliked, the Shafi’i school forbidden. All four reverse the rule where death is not yet certain, and we found no school addressing a coroner’s investigation or a burial permit — a delay forced by Canadian law has no classical ruling of its own.

What to do about it
- Contact a funeral home experienced with Muslim families immediately.
- Notify the masjid's funeral coordinator.
- Expect delay if the death was sudden or unattended.
