In Quebec, no probate fees, and no verification at all for a notarial will.
The Canadian position
Probate is administered through the Superior Court of Québec. Assets passing by beneficiary designation or survivorship fall outside the calculation.
That is why probate planning concentrates on designations and joint ownership.
The Islamic position
Probate cost is an administration expense, payable from the estate before the shares are calculated.
But every technique that reduces it moves assets outside the estate, and whether that also removes them from the faraid pool is disputed among contemporary scholars — so the two goals may genuinely conflict.
All four schools work through the estate in the same order: the cost of preparing and burying the body, then debts, then bequests up to one third, and only what is left is divided by the fixed shares. The disputes are not about the sequence but about two rankings inside it.
